Abstract

El rápido desarrollo del Metaverso plantea nuevos desafíos legales dentro del marco normativo europeo, lo que requiere un análisis exhaustivo de cuestiones clave como la protección de datos personales, los derechos de autor y el comercio electrónico. Este trabajo examina las implicaciones jurídicas del Metaverso, con especial atención a las particularidades de la legislación europea. Se profundiza en aspectos como la gestión y protección de los datos personales en entornos virtuales, la protección de los derechos de autor sobre las obras digitales y las normativas que rigen el comercio electrónico en este nuevo panorama digital. A través de un enfoque interdisciplinario, que integra las nuevas tecnologías, la propiedad intelectual y la regulación del comercio online dentro del marco legal europeo, el análisis ofrece una visión completa de los riesgos y oportunidades legales asociados al Metaverso. Mediante el uso de casos prácticos, el análisis de las normativas en evolución y una perspectiva orientada hacia el futuro, este trabajo proporciona una base sólida para comprender y gestionar este nuevo entorno digital conforme al derecho europeo.

Biography

Massimo Farina is Associate Professor of Legal computer Science at the Department of Electrical and Electronic Engineering (DIEE), University of Cagliari. He is Data Protection Officer (DPO), according to Article 37 of EU Regulation 2016/679 (GDPR), at University of Cagliari. He received a MSc. in Law at the University of Cagliari and a PhD degree in "Law and New Technologies" at the University of Bologna (CIRSFID). Moreover, Massimo Farina obtained the Second level Masters in "Computer law, theory and technique of legislation" (University of Roma, "Sapienza"), in "Data Protection Officer and privacy law" (university of Napoli, "Suor Orsola Benincasa") and "Internet of Humans and Things" (University of Roma, "Tor Vergata"). Massimo Farina is Director of university laboratory "ICT4Law & Forensics" and Board Member of ANDIG (Associazione Nazionale dei Docenti di Informatica Giuridica e di Diritto dell'Informatica). He is, also, member of the National Interuniversity Consortium for Telecommunications (CNIT) of the research unit at the University of Cagliari. Since 2007, he is "Research Fellows" of the Networks for Humans laboratory (Net4U) (formerly Multimedia & Communications Laboratory - MCLab), Department of Electrical and Electronic Engineering, University of Cagliari and since 2017 he is " Affiliate Scholar "of the Information Society Law Center - Coordinated Research Center in" Information Society Law, "Department of law "C. Beccaria", University of Milan. Prof. Farina, whose research focuses on personal data protection, e-government, e-health, software law, AI and robotics, and cybercrime and digital forensics, has published widely on legal informatics and IT law, contributing monographs, book chapters, and numerous journal articles .
